Recently, Justice Roberts has been in the news concerning the issue of Gay Marriage and his decision shaped what many people thought of him and the supreme court has fallen out of favor with republicans. The approval rating of the Supreme Court has dropped to a record-low 18 percent with voters while the democrats are roughly around 75 percent approval rating which is a very large gap. Justice John Roberts joined the liberals so that the Affordable care act could passed and then he did it again when he was the swing vote that legalized same-sex marriage. Since Bush brought in Justice Roberts, he has been very liberal recently with his views. Do you think it is right for the republicans to turn their backs on Roberts? Explain?
Great topic. we need more specifics on the cases in which Roberts voted with the liberals. Otherwise, let's focus on exactly why Roberts upheld Obamacare. Think about that & please provide a little more guidance.
ReplyDeleteI think it was fair they turned their backs on him. If he switched parties that often he can't be a loyal or valuable asset to any party. Additionally, they might not want to associate with him having an approval score that low.

Roberts should not be biased in his opinion and favor Republican views just to win approval from them.

ReplyDeleteI believe it was in the Republicans' favor to abandon Roberts. A judge whose votes have swung so frequently on a number of decisions cannot be of assistance to them so it is unsurprising that they considered him a liability. In addition, Supreme Court justices must maintain an impartial stance on any and all cases or hearings. Roberts did the exact opposite when he chose to favor the Republican party in his attempts to obtain their approval.
ReplyDeleteThe Republicans have every right to turn against Roberts. Even though Bush, a Republican, appointed him to the Supreme Court, the party does not have to continue to back him throughout the duration of his term. Roberts perhaps was not as conservative as Bush or other Republicans would have excepted, and consequently, the party does not have to support him. Especially since Justices are not elected, this lack of support from the Republican party has little effect on the rulings of Roberts. In fact, Roberts has been consistent with his rulings about the Affordable Care Act and legalizing gay marriage as he sides with what he claims that laws says, not what it should be.
ReplyDeleteI think that it acceptable that the Republicans abandoned Roberts. As a judge chosen by the Republican party, he should continue to support the Republican Party. He made decisions that sided with the Democratic party even though he was chosen to represent Republican views. Roberts hurt the balance between the two parties, which makes it acceptable for Republicans to abandon him.

ReplyDeleteI believe republicans have every right to turn their backs to Roberts. Bush, being a democrat, hired Roberts in order to have a more conservative view on matters, similar to himself. Judges are supposed to never be one sided or influenced, which is what Roberts has been displaying due to his more liberal choices. Roberts has been making certain choices in order to gain more approval, which is why I believe republicans no longer need to support him.
ReplyDeleteRepublicans can change their opinion on Roberts, as they had expected him to be their conservative voice in the Supreme Court, who could represent their interests. However, although political parties tend to nominate appointees based on their political leanings, Supreme Court is meant to act as impartial structure free from political games. Their role in government is ruling the constitutionality of laws, not to further political group's agenda. Meanwhile, it is also Roberts' right to turn his back on the Republicans and pursue case rulings as he interprets the Constitution.
ReplyDeleteRoberts ruled in favor of Affordable Care Act, mainly because he viewed the act and the Congress' reasoning for passing it above the dissenting conservatives' urgings to kill the bill. Roberts wrote in his majority opinion of King v Burwell that "[the Court] must respect the role of the legislature, and take care not to undo what it has done". He reasons that the bill's purpose was to expand health care to millions and improve the health care market, not to deny coverage for residents of certain states. Thus, he chose to interpret the wording of the bill in a way that remains consistent with the bill's purpose.
Even though I agree with Roberts stance on gay marriage, I think there is some merit to the Republicans "turning their back" on Roberts. The expectation throughout the years has been for the justices to align with the party who nominated them, and Roberts clearlyrics hasn't been doing that. However, in an ideal world, judges shouldn't be pressured into aligning with what the parties think although this is not realistic. Roberts has seemed to screw over the Republican party on several key issues and there is some merit to the GOP not favoring Robert's anymore
ReplyDeleteEven though Roberts was elected as a republican judge, I think that he is entitled to change his opinions in whatever way he deems fit. Judges should not be pressured to align with a political party. In retrospect, the majority of the judges have a mixture of both democratic and republican ideals in them, making them independent. Therefore, judges should solely vote for what they believe is just and right for the country, and not base their decisions on the drama of politics.
ReplyDeleteIn my opinion, I feel that the Republicans have a right to be upset, as any party probably would be, but should not expect Justice Roberts to forego his personal beliefs to align with the party that nominated him. With that being said, even though the Republicans are entitled to be a little sour over this subject, they cannot get too upset just because Justice Roberts is making decisions based on his morals. In fact, I feel like it would even be a little bit concerning to see a supreme court justice just throw his ideals out the window and be a puppet for the political party that nominated him. Like others have said before, justices should use their beliefs as the guide to making decisions, not what political parties want.
ReplyDeletePersonally, I do believe the other Republicans do have reasons to be frustrated with Roberts, but as an American citizen, Roberts is entitled to his own decisions and opinions. In other words, although he is a Republican, he does not have to abide to every standard or belief Republicans hold. As a Supreme Court Justice, Roberts should be making decisions on whatever he believes in, not what his political party deems correct.

If they supported him because of certain views, and he completely flip-flopped on them, there's no reason for them to not agree with him anymore. They don't owe him anything, as he was given an incredibly powerful position in office to begin with.

However, I don't believe that Roberts should go against his personal opinion just to humor the Republican party. The justices are their to provide their unbiased opinion, therefore they should not be swayed one way or another.
ReplyDeleteThe Republicans, of course, can be upset with Roberts for his recent rulings. Roberts should not vote to reflect the views of the Republican party for his job should not have anything to do with his affiliation with said party. His job is to be impartial and to interpret the Constitution. If his interpretation of the Constitution happens to be seen as liberal, then so be it.

ReplyDeleteI believe that every Supreme Court Justice should try their best to interpret the Constitution without personal bias or party influence, so I dont think its right for the GoP to turn against Roberts. While they may disagree with a decision, as long as a justice is honest and holds no bias he or she should be respected by all no matter if the justice does not align with a party's agenda.
ReplyDeleteI believe that it was right for Roberts to do whatever wanted. Although he was appointed to provide conservative views on the Supreme Court, I feel that if his policies are liberal what is the issue with that. I cannot not see how that is bad at all. He upset republicans, but he made a design that I felt is very good and many others in the country felt was necessary. Although Bush does take a lot of blame on this, I do not think that he is one to be blamed. He put him in to make him conservative, like he was ruling in the past, but now that he changed his ideas nothing Bush could do with that.
ReplyDeleteI believe that Justice Roberts is entitled to his opinion and should not be obligated to decide in a certain way if Roberts doesn't agree with the Republican party. The Supreme Court seems to be closely divided along party lines, and they should not be robotically pursuing an agenda, and form biased alliances. Instead, Justice's should expand their horizon. Republicans need to be mindful that Republican Supreme Court Justices are NOT party judges.
ReplyDeleteJustice Roberts decision was critical and ideal for the Democratic party, however Justice Roberts is a Republican and for him to be a swing vote in something that wouldn't have been passed if it weren't for him changing his mind at the last second seems hypocritical. I agree with Justice Roberts stance on gay marriage but at the same time I question his loyalty to his respective political party as well.
ReplyDeleteRoberts has the right to rule however he wants to rule. With that being said, there are 4 conservatives and 4 liberals for a reason. Upsetting that balance would prove to be a disaster, as every decision would skew liberal. Ultimately though, Roberts and the other judges should, in theory, rule how they believe, which is what Roberts did.
ReplyDeleteI think it is fair that replublicans turn their back on Robert . Justice Robert should has his reason of his decisions. It is something that will make the party angry when he change his position. However, the supreme court is a part of the government that should make desicions without influence of parties. I think this is a good move, if it did not break the balance of the political parties.
ReplyDeleteI believe they are in the right to be upset with him. The supreme court is meant to be relatively neutral in alignment as a whole, and Roberts was chosen for his republican views. When he no longer represents those views, republicans can be angry. While it is fine that they disapproved, this doesn't mean Roberts was in the wrong. I think the justices should try to be as little influenced by party opinion and the games of politics as possible, which is why they are appointed for life.
ReplyDeleteI think that Roberts views changed with time. I do to believe he intentionally gained support of Republicans to later switch to a more liberal mindset. His thoughts and decisions are modernizing. If Republicans choose to turn their backs on Roberts, thats really all it is. He cannot be removed without serious reason and "not being conservative enough" is not a valid reason to remove a justice.
ReplyDeleteBeing that he changed sides the republicans not being able to trust him is justified through his actions of choice.He won't be able to be removed but because the republicans don't have his back the likelihood of him winning is low.
